Judge Hein says, based on the merits of the case, court costs (fees, court reporter costs, etc) should be split amongst the parties. Rule 54 of Ohio Rules of Civil Procedure say that costs should be awarded to the winning party unless the court says otherwise. Is this fair because of the merits of the case and/or because Joseph Foreman filed his own countersuit (which was ultimately dismissed)?
